The Trump administration is drafting rules to restrict Chinese AI lab's remote access to overseas AI chips.

Existing U.S. controls cover exports, reexports, and transfers of controlled technology, while federal law does not explicitly address remote access through cloud infrastructure.

Now, US Commerce may address that gap by conditioning chip shipments to foreign data centers on customer screening and restrictions against Chinese remote users.

This would make identity checks and access controls conditions for receiving advanced U.S. GPUs.

BIS's May 2026 guidance already says licenses are required when advanced computing items go to China-linked entities even when those entities sit outside China.

Commerce's regulatory plan now confirms BIS is preparing RIN 0694-AJ90, an interim final rule that will formally rescind the Biden-era diffusion framework and create a streamlined replacement.
If this new rules are implemented, overseas data centers serving Chinese customers would face heavier screening requirements and could risk access to controlled U.S. chips.
